CHICAGO CHILD SUPPORT
In Illinois, like many other states, Child Support is determined by statute. Although the formula for determining the amount of support appears simple, it is often far more complex than it appears. Hiring a knowledgeable Chicago child support Attorney is crucial. This is especially true if your children are young and support will be paid for a period of many years.
Under 750 ILCS 5/505, child support is determined by the following formula:
(1) The Court shall determine the minimum amount of support by using the following guidelines:
Number of Children
Percent of Supporting Party’s
6 or more
The party who is ordered to pay child support is also allowed to deduct certain taxes and expenses from their “gross” income and pay support based on their “net” income, after taking the allowable deductions. This is where a knowledgeable Chicago child support lawyer can be especially helpful. The most common allowable deductions are Federal taxes, State taxes, Social Security (FICA) payments, Medicare payments, Health insurance premiums and prior obligations of support or maintenance actually paid pursuant to a court order. However, there are several lesser known allowable deductions that an Attorney may argue apply to your case.
At the Law Offices of Brian M. Radke, I make it a point to scrutinize and analyze all income and possible deductions to ensure my clients are ordered to pay or receive child support payments that are fair and reasonable to provide for their children. Whether you are seeking child support or you are being asked to pay child support, the Law Offices of Brian M. Radke is here to assist you. Call Brian Radke today at 847-813-6011.
